The PARTIES have agreed on the following form of payment: COLLECTIVE billing at the end of the month / PREPAYMENT by bank transfer to a bank account on the basis of a proforma invoice / BY BANK TRANSFER within 14 days of receipt of a properly issued invoice / BY CARD on the day the equipment is issued

The LESSOR makes the equipment available, as listed above, at the time indicated above. The LESSEE declares that he/she has checked and accepts the condition of the equipment he/she rents.
In the case of equipment being shipped by courier, the LESSEE is obliged to inspect the condition of the equipment immediately upon receiving the package. The absence of feedback concerning any potential damage is considered by the parties to be equivalent to the acceptance of the condition of the equipment.
The LESSEE picks up the rented photo, film or lighting equipment and returns it at CamCam office at 195 Rolna Street, Warsaw, at the time agreed upon during equipment booking. The equipment is collected and returned by the LESSEE.
Terms and conditions, including the place of equipment pick-up and return, are subject to change if the PARTIES agree otherwise during the booking process.
In the case of shipping by courier, the cost and organization of the return shipment falls on the LESSEE of the equipment. The LESSEE is obliged to choose a service that will ensure the return of the equipment to the CamCam headquarters at the time specified in the contract. The LESSEE is obliged to insure the shipment. Neither the LESSEE nor the LESSOR are responsible for any potential delays in delivery caused by the courier company.
The LESSEE bears full legal and material liability for the equipment provided to him/her until it is returned to the LESSOR. The financial liability of CamCam A. i W. Zych Sp. j. for damages resulting from the failure of the rented equipment is limited to the amount of the rental fee specified in the agreement.
The LESSOR is not responsible for any electronic data left on storage media (cards, built-in drives) in the rented equipment.
In case of loss of the equipment or parts thereof, or damage thereof in any manner that makes repair impossible, the LESSEE will pay CamCam A. i W. Zych Sp. j. the replacement value of the lost or damaged equipment. This value will be determined based on current equipment prices.
The LESSEE is obliged to return the rented equipment in non-deteriorated condition than when received from the LESSOR. The equipment must not be damaged. If the equipment needs to be repaired, the LESSEE will bear the cost of repair.
The LESSOR reserves the right to fully inspect the equipment within 24 hours of returning it to the CamCam warehouse. Any malfunctions or damages found during this time, that were not discovered during the return, will be documented photographically and reported to the LESSEE. The LESSEE will be charged for their repair.
CamCam A. i W. Zych Sp.j. rents the equipment that is fully operational and guarantees its proper operation provided it is used as intended. If there is an equipment failure not caused by the LESSEE, CamCam A. i W. Zych Sp.j. will repair the equipment at its own expense and waive the rental charges for the damaged equipment, provided that the LESSEE immediately informs the LESSOR of the situation. If information on the failure or malfunction is reported after the end of the shooting schedule or during the return of the equipment, the LESSOR reserves the right to charge the full rental fee for the equipment.
The rental fee for the equipment for the period specified in the Rental Agreement is the product of the price for one day (24 hours) of equipment rental and the number of days of the rental period. The prices listed in the price list are net prices.
If the rental period is extended without the consent of the LESSOR, or in the case of failure to return the equipment at the time fixed in the contract – the LESSOR has the right to charge an additional fee of 150% of the rate for each additional day of rental started.
The LESSOR may waive the additional charge if the extension was caused by force majeure and the LESSOR was informed on it before the date specified in the contract for the return of the equipment.
Any disputes arising between the parties are to be settled in accordance with the provisions of the Polish Civil Procedure Code by the Court having jurisdiction over the seat of CamCam A. i W. Zych Sp.j.
